It is also interesting to note that Alito, in his recent confirmation hearings, describes (to Democrats’ chagrin) Roe v. Wade precisely accurately as “an important precedent” in contrast to John Roberts’ labeling as “settled law.” It gives me a lot of confidence in Alito’s abilities as a judge to see that he recognizes, perhaps better than anyone, the role and responsibilities of the Supreme Court in interpreting the law and not making it.
