Due process and Guantanamo

Q and O comments on the Guantanamo detainees and raises some troubling questions (link via Instapundit). Personally, I do not support the indefinite detainment of foreign combatants without some kind of due process and trial. Certainly, we cannot expect to gain any information from them after three plus years that we have not already gotten. I believe that most of them could safely be released without posing a large threat. Those that do pose a threat should have evidence brought against them (even if the trial would need to be classified to protect sources) and have that determination made by a judge or a military tribunal.
